These General Terms and Conditions 'GTC' apply to all business relationships between 2Tech Technology AG (hereinafter referred to as 'Company', 'we', or 'us'), located in Switzerland, and its customers (hereinafter referred to as 'Customer' or 'you').
By accessing our TechDashboard service, subscribing to a plan, or using any part of our software, you explicitly agree to be bound by these Terms & Conditions. Any deviating conditions of the Customer are generally not recognized unless we have expressly agreed to their validity in writing.
The presentation of products and services on our platform does not constitute a legally binding offer but rather an invitation to place an order. A binding contract is concluded when:
3.1. Service Provision: We provide a SaaS (Software as a Service) platform that allows users to monitor metrics, run analytics, and manage business data. We strive for 99.9% uptime but do not guarantee uninterrupted availability due to maintenance or technical issues beyond our control.
3.2. Subscription Term: Subscriptions are concluded for a specific term (e.g., monthly or annually) and renew automatically for the same duration unless cancelled by either party in accordance with Section 5.
4.1. Currency: All prices are quoted in Swiss Francs (CHF) unless otherwise stated. Prices include statutory Swiss Value Added Tax (MWST) where applicable.
4.2. Payment Processing: Payments are processed securely via third-party providers such as Stripe or Wallee. We do not store sensitive credit card data on our servers.
4.3. Default: If payment fails, the Company reserves the right to suspend access to the service immediately until outstanding dues are settled.
You may cancel your subscription at any time via your account settings. The cancellation will take effect at the end of the current billing period.
Important Note (Swiss Law): Unlike in the EU, there is no statutory 'Right of Withdrawal' (14-day cooling-off period) for online B2B services or digital goods once performance has begun. Therefore, all fees paid are non-refundable, except where explicitly required by law.
The Company is liable for direct damages only in cases of intent or gross negligence. Liability for slight negligence, indirect damages, or consequential damages (such as loss of profit or data loss) is excluded to the fullest extent permitted by Swiss law (Art. 100 OR).
We do not guarantee that the software will meet your specific requirements or that it will be error-free.
We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP/DSG) and, where applicable, the EU GDPR.
All rights, titles, and interests in and to the TechDashboard platform, including software, design, text, and graphics, remain the exclusive property of 2Tech Technology AG. You are granted a limited, non-exclusive, non-transferable license to use the service for your internal business purposes.
We reserve the right to amend these Terms & Conditions at any time. You will be notified of significant changes via email or a dashboard notification. Continued use of the service after such changes constitutes acceptance of the new terms.
These Terms & Conditions and the contractual relationship are governed exclusively by Swiss substantive law.
The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Bern, Switzerland.
